UPPER CARS LIMITED – TERMS & CONDITIONS

1. Bookings

All bookings must be confirmed by Upper Cars Limited via email or SMS. Customers are responsible for ensuring all details (times, locations, passenger numbers, luggage) are accurate at the time of booking.

2. Pricing & Payment

All prices are quoted in GBP (£). Final pricing is based on the booking details provided. Additional charges may apply for extra mileage, waiting time, route changes, or undeclared passengers/luggage.
Payment may be required in advance unless otherwise agreed.

3. Cancellations

  • 24+ hours’ notice: no charge
  • 12–24 hours: up to 50% charge
  • Under 12 hours or no-show: up to 100% charge

4. Waiting Time

  • All passengers must be ready at the allocated pick up time or additional charges apply.

5. Delays

We monitor flights where details are provided. However, we are not liable for delays caused by traffic, weather, or other events beyond our control

6. Passenger Conduct

Passengers must behave respectfully. We reserve the right to refuse service to anyone who is abusive, unsafe, or under the influence.
Customers are liable for any damage or excessive cleaning required.

7. Luggage

Luggage must be declared at booking. We may refuse excess luggage if it cannot be safely carried. We are not liable for loss or damage unless caused by negligence.

8. Vehicles

We may substitute vehicles of similar or higher standard where necessary and may use licensed subcontractors.

9. Liability

We hold appropriate insurance as required by UK law.
We are not liable for indirect losses, including missed flights due to circumstances beyond our control. Liability is limited to the booking value where permitted by law.

10. Child Seats

All passengers must provide their own appropriate child seats for any child under 12 years old or under 135cm in height, in accordance with UK law. Child seats must be suitable for the child, properly fitted, and in good condition. Passengers accept full responsibility for the provision, installation, and use of child seats. Upper Cars Limited accepts no responsibility for the supply, condition, or fitting of any child seats.

11. Force Majeure

We are not liable for failure to perform services due to events beyond our control (e.g. severe weather, road closures, industrial action).

12. Data Protection

We process personal data in line with UK GDPR and only use it for booking and operational purposes.

13. Complaints

Complaints must be submitted within 7 days of travel. We aim to respond promptly.

14. Governing Law

These terms are governed by the laws of England and Wales.
